Ursula Sues A-Plus for GH¢10M

The Minister for Communications has dragged Hiplife Artiste, Kwame Asare Obeng aka A-Plus before an Accra High Court for defamation, demanding GH¢10 million damages.

The plaintiff, Ursula Owusu–Ekuful says she was defamed when the musician on May, 23 2018 in a Facebook post accused her of being corrupt.

No Way

The suit follows the elapse of a seven-day ultimatum for the musician to apologize and retract the said defamatory remarks.

The controversial musician and political activist had called the bluff of the minister insisting he would never apologize.

“If I apologise, Nimokafui and Ayetefrem and chalablim and Salafim should kill me. You think this is 2017. I only helped you to win power. I’m not part of your nonsense. I’m not afraid of anyone. Not a single soul. I’m wild like a lion!!! Bring it on. You’ll be humiliated.”

A-Plus is reported as having maintained: “Thieves!!! Bunch of fucking thieves. When you were waking me up at dawn to accuse John Mahama of everything did he sue me? Intolerant motherfuckers!!! You people will regret knowing me. I will fight you till I drop dead!!! This Kwame A Plus guy is a whole new Ghanaian. I’m not afraid of anyone. You can’t intimidate me. You just can’t. Nobody!!! I’m not one of the people you can intimidate in Ghana. Fuck that shit!!!”

The Plaintiff avers that the Defendant has shown no remorse and has evinced a clear intention to deliberately tarnish her image and reputation without any just and probable cause.

Writ

According to the writ filed by Gary Nimako Marfo of Safo & Marfo @ Law, A-Plus further impugned that “Kwesi Nyantakyi is only being sacrificed to cover up the 89/178 million dollars GVG Kelni stinking scandal.”

The Defendant further stated in the said publication referred above Ursula was involved in “some shady deals at the Communications Ministry and National Communication Authority (NCA).”

Mr. Marfo stated that the musician further stated that “it is even suspected that this dodgy deal is the reason why a board member has resigned and many who do not want to be implicated in anyway will follow.”

In the view of the plaintiff who is also the Member of Parliament for the Ablekuma West Constituency, the defamatory Facebook publications authored by the musician have generated several comments and media attention in Ghana and abroad ostensibly intended to tarnish her hard won reputation.

She argued that the defamatory statements published by the Defendant were carefully calculated to tarnish her image and hard-won reputation adding that the “defamatory statements were made without any just cause and was intended to cause her public ridicule, disaffection and to reduce her image in the eyes of right thinking members of society.”

Reliefs

As a result, the minister wants the court to declare that the Defendant’s publications on Facebook that she is “corrupt” is libelous and defamatory of the Plaintiff and same was made without any reasonable, just or probable cause.

The Safo & Marfo @ Law, Lawyer also wants the court to declare that the Defendant’s publication on Facebook among others that “Kwesi Nyantakyi is only being sacrificed to cover up the 89/178 million dollars GVG Kelni stinking scandal” is libelous and defamatory of the Plaintiff and same was made without any reasonable, just or probable cause.

Mr. Nimako aside, the declarations seeks an order of injunction directed at A-Plus, agents, assigns, privies from continuing to make any further defamatory publication about the Plaintiff.

The minister is inviting the court to order A-Plus to retract the said defamatory publication and render unqualified apology in the same prominence on Facebook and other national newspapers and as well take immediate steps to expunge the defamatory publication from Facebook forthwith.
