Killed MP’s Pathologist Still Not in Court — Despite Served Subpoena

Further hearing of the case over the murder of Joseph Boakye Danquah-Adu, the New Patriotic Party (NPP) Member of Parliament (MP) for Abuakwa North in the Eastern Region before an Accra Central District Court suffered another hitch yesterday.

This was because Lawrence Edusei, the pathologist who performed the autopsy on the late legislator again failed to appear before the court after several orders to do so.

The court has for the past two months been on the heels of the pathologist in a fruitless attempt to get him before the court to explain why the full autopsy is still not ready months after the death of the MP.

At the last court date, Dr. Edusei did not appear before the court as expected prompting the magistrate Arit Nsemoh to order that he be subpoenaed.

The matter was not different yesterday when the case was due for hearing, although the prosecution insists the doctor has been served to appear.

The trial magistrate had no option than to again order that the Dr. Edusei be served the next court date to appear.

DSP George Amegah had at the last hearing informed the court that the subpoena was prepared by the court registrar and sent to the doctor as well as the Head of Pathology Department of the Korle-Bu Hospital on November 24, 2017.

On October 10, 2017, the court ordered the pathologist to release the full autopsy report on the former MP for Abuakwa-North to the police to aid investigations into the case.

The order followed an application by the prosecutor who stated that Dr. Edusei had failed to release the report and that all attempts by the police to obtain it had proved futile.

The delay in the release of the report, the police claimed, was hampering their efforts to build a solid case against Daniel Asiedu, aka Sexy Don Don and Vincent Bosso, the two suspects linked to the murder.

Asiedu and Bosso are currently before the court awaiting the commencement of committal proceedings which would facilitate their eventual trial at the High Court.

Daniel Asiedu, 19, aka Sexy Don Don – a phone dealer and Vincent Bosso aka Junior Agogo – a phone repairer, are in police grips over the murder of the legislator fondly called JB.

The accused persons were hauled before the Court two days after an Accra High Court had discharged them over the murder of the legislator.

The Attorney General and Minister for Justice had earlier entered Nolle Prosequi (NP) to drop previous charges against the accused persons in respect of the case which was at the stage of empanelling a seven-member jury for the trial.

Sefakor Batse, a Senior State Attorney, had told the court, presided over by Justice Lawrence L. Mensah, that per Section 54 of the Criminal and Other Offences Act, the AG had entered NP in respect of the case.

Daniel Asiedu and Bosso were subsequently rearrested minutes after their discharge and fresh charges preferred against them.

In the instant case, Sexy Don Don has been slapped with the charge of murder while Agogo faces abetment of murder.
