Suspects in Gyan’s Rape, Sodomy case cry over delay in court trial

Osarfo Anthony, a journalist who was arrested and accused three years ago of extorting money of a sum of  Ȼ25,000 from Black Stars captain Asamoah Gyan through blackmail is crying over delay in judgement and final prosecution.

He was arrested in connection with other colleague by name Chris Handler, a blogger and musician Ekow Micah, they were reported to have coned together to extort such amount of money from the Ghanaian striker.

Sarah Kwablah accused Asamoah Gyan of forcefully sleeping with her when he had not proposed love to her. In addition, was an evidence of videos to prove her side.

Police in Ghana later arrested Sarah, and Osafo Anthony, Chris Handler as well as Ekow Micah, and charged them with conspiring to extort money from Samuel Anim Addo, the manager of Asamoah Gyan.

Because of how serious and the much attention the issue got, court was the rightful place to handle the issue at, three years down the line, the case at the law court has been of delay to the highest level.

However, the accuse Osarfo Anthony is frustrated and complain of how the state is delaying the case, calling it unfair. Speaking to The Publisher Newspaper, he is calling and seeking for the law to take its due course in securing final judgement to the matter.

‘’The big scandal was spread with propaganda by the Gyan’s family, they fueled media trial, clouded minds, and pitched society against me. The state took the case to court, and for 3 years now, if I take their (Prosecution, witnesses, and complain) days of absenteeism plus adjournments together, they have not appeared in court for 2 years.’’ – he said.

According to him, he leaves whatever duty he is adhere to and go to court. BENCH WARRANT and calling for his re-arrest will be the next option if he fails to show up at court. The accuse is worried on how the law court tolerates such impunity of NO NOTICE from the prosecutor.

He believes and with level of hope that, the law court has been reluctant on the above case because of the society definition of the Ghana Black Stars Captain, and that if it had been someone not that much of influence in the country, the issue would have been solved to the cleaners as at now.

‘’ I know I’m INNOCENT, and so ever ready to face full trial — why are they running away? Why is the judge not closing their case so I open my defense? ‘’ – he added.

Explaining further, he is calling for JUSTICE on the case. He believes failure by the law court to secure JUSTICE on issues at the law has created an avenue for INSTANT JUSTICE here in the country.

 

BACKGROUND

The facts of the case are that the complainant is a businessman and the manager of the Asamoah Gyan Foundation. Prosecution said Chris is the owner of GHbase website while Sarah is a student resident at Dunkonaah at Kasoa.

According to reports from ACP Atibilla at time of the case, Anthony was an employee of Chris and that in the month of June 2015, an alleged sodomy story involving the skipper of the Black Stars, Asamoah Gyan, broke in the Ghanaian media.

The prosecutor stated that Sarah alleged in a publication that Asamoah Gyan had a sexual affair and unnatural carnal knowledge of her and she became pregnant afterwards.

The Ghana captain is on record to have revealed he met the woman on social media after she sent him a message, and had sex in her apartment later on when he visited Ghana for the 2015 AFCON preparation.

 

Alleged Extortion Scheme

ACP Atibilla indicated that Sarah discussed the issue with Micah and the two met with Anthony and Chris to publish the story on their website to scare Asamoah Gyan to give them money.

He said Anthony and Chris published the story on their site and promised to publish a sex tape of the affair between Gyan and Sarah in their subsequent edition.

The prosecutor further told the court that a witness in the case read the story on GHbase.com and quickly alerted Samuel to enable them stop the publication, adding that Samuel contacted the publishers on phone and they threatened to make public the sex tape unless a substantial amount was paid or a house was bought to compensate Sarah.

ACP Atibilla said the complainant, in a bid to protect the image of his client, asked the publishers to hold on with the publication whilst he thought of the issue. He stated that Anthony and Chris kept on threatening to publish the video to defame Asamoah Gyan and called for an urgent payment of the money.

Judge Frustration

The Accra circuit judge handling over the issue, her Honor Ms. Afia Agbanu Kumador has on several grounds threatened to discharge Sarah Kwablah and three others in the alleged sex video scandal involving Black Star Captain Asamoah Gyan.

The court has adjourned the matter many times because the state prosecutors were absent for three consecutive times as well as Mr. Samuel Anim Addo, Manager of Asamoah Gyan .

Lawyer for the accused, told the court to discharge the accused since the case has suffered several adjournments and prosecution is not ready to carry on the case. Investigation by this Newspaper indicates, the judge presiding over the case has express with great worry over the period of delay on the case and has threaten to discharge the accused if the prosecutor refuses to show up.

Asamoah Gyan Acceptance on sex scandal, rape accusation

Captain of Black Stars of Ghana, Asamoah Gyan, opened up finally on what transpired between him and the lady, Sarah Kwablah who accused him of rape. Gyan admitted of having sex with the lady but maintained that they both enjoyed the sex.

The Ghana captain revealed he met the woman on social media after she sent him a message, and had sex in her apartment later on when he visited Ghana for the 2015 AFCON preparation.

However, the Ghana captain claimed after 2015 AFCON tournament, He came to Ghana and he met with the lady at STC where he train, introduction however was done to his colleagues and after the training, they to her house and they had sex. Although the captain confessed to having had sex with Sarah, he denied raping her.

“I will not deny sleeping with Sarah Kwablah, we both enjoyed the love making but she twisted the story and accused me of raping her, we had a good time.’’ – he said.

Case Adjourned

The accuse believes the law must to look into for betterment going forward which it should be adhere to and that, if it was to be something good the police service and law court has done, they would have taken credit for it. The police instead of providing SECURITY for the citizenry are rather becoming a THREAT to our security. Nelson Mandela once said and it is indeed true that “When a man is denied the right to live the life he believes in, he has no choice but to become an outlaw”. JUSTICE MUST BE SEEN TO BE DELIVERED to ensure sanity in the system. The court must be reminded that JUSTICE DELAYED IS JUSTICE DENIED.

A damage has been caused to one’s life through public outrage, a family is aggrieved yet the aforementioned – a delayed justice, continues.  This is worrying and makes it difficult or even impossible not to fall for the speculation that it is in the interest of somebody that the case is suffering this fate.

Information has it that he has at his disposal a couple of communication devices. With such unimpeded communication freedom against the backdrop of his track record, a speculation that he is still on top of his criminal activities cannot be dismissed as unfounded without interrogating same.

Therefore, the delay in justice relates to the delay in actual deliverance of justice or passing of the final order into the matter after the roundup of the entire proceed­ings in full conformity of the prescribed procedures in respect thereof.

The justice as such is becoming costlier, in terms of time and money. Since the citizens are unable to apply costly lubrication to the parts of mechanism attached to the system, their work is delayed and justice goes out of their reach. It is very shameful we are alluding justice to such instance in our dear country.

The accuser further believes unless bold steps are adhered to in bettering our system at the law court to ensure speedy disposal of cases, the present system cannot give a desirable performance.

Reports indicates that, next court hearing is 22nd August, 2018 at the Circuit Court 9 in Accra.
